Following approval of the Development Consent Order, EDF are now beginning site clearance and providing required documentation against the DCO Requirements list. Two are of particular concern to Minsmere Levels Stakeholders Group, The final design of the Hard and Soft Coastal Defence (HCDF/SCDF) and the accompanying Coastal Processes Monitoring and Mitigation Plan (CPMMP).
Requirements 12 and 14 concern the CPMMP and are to be discharged by East Suffolk District Council and the Marine Management Organisation respectively.
Requirement 19 is for the final design of the HCDF/SCDF to be submitted, considered and discharged when agreed with East Suffolk District Council, as the statutory coastal management authority and the MMO as part of the structure will be below the High Water Mark.
Documents have been submitted to ESC and MMO to Discharge Requirements 12 and 14, however as there is no final design for the HCDF/SCDF and one is yet to be submitted against Requirement 19, we have objected to the consideration of Requirements 12 and 14 until such time as Requirement 19 is submitted and approved. We also requested that the Department for Levelling-Up, Housing and Communities call in the two applications, but it turns out that unlike most planning applications, discharges of requirements requests cannot be called in under existing planning law. So it is down to ESC and MMO to decide on what should happen to these two requests.
Usually there is a limited amount of time that authorities can take to consider Discharge of Requirements applications but the MMO has requested that the time for consideration for these two requests to be extended to early in the New Year (2024) and this has been accepted by Sizewell C Co Ltd and will apply to both DoR 12 and 14.
